Terms of sale

This is an English translation provided for convenience. Only the French version is legally binding.

These terms govern the sale by FPH, a French single-member limited liability company (EURL) with share capital of €177,000, whose registered office is at 2 rue Percheronne, 28000 Chartres, France, registered with the Chartres Trade and Companies Register (RCS Chartres 932 293 129, SIRET 932 293 129 00015), EU VAT number FR23932293129, e-mail contact@minivanvintage.fr, of the paid services of Minivan Vintage (minivanvintage.fr): listing publication, extension, featured placement, bump and professional subscription. They supplement the terms of use. The service is intended for persons located in France; the French version of these terms is the binding one.

1. Services and prices

The services and their prices are described on the Prices page. Prices are shown in euros, including all taxes (French VAT at the current rate); the professional subscription, reserved for professionals, is shown both excluding and including VAT. A listing is published for 60 days. Launch offers (free listings, first-listing price) are valid within the stated limits. Until January 31, 2027 inclusive, posting a listing is free, with no limit on the number of listings; options (extension, “Featured” placement, bump) and the professional subscription remain paid. A listing published for free during this period stays online for free until the end of its listing period, even after that date.

2. Order and payment

Payment is made online by bank card through our provider Stripe; FPH never has access to card details. An invoice is issued for every payment and remains available in your account. A summary of your order is sent to you by e-mail.

3. Performance of the service and legal guarantee

The service is performed when the listing is published, after it has been checked. A listing refused before any publication is refunded. A listing removed for breaching the terms of use (fraud, non-existent item, prohibited content) gives no right to a refund. Our digital services are covered by the legal guarantee of conformity (Articles L224-25-12 et seq. of the Code de la consommation, the French Consumer Code): if the service does not match what was ordered (listing not published, featured placement not applied), you may ask for it to be brought into conformity or, failing that, for a refund.

4. Right of withdrawal

If you are a consumer, you have fourteen days from your payment to withdraw (droit de rétractation), without giving any reason and at no cost. To do so, write to us through the contact form or at contact@minivanvintage.fr, for example using the form below. We refund you within fourteen days, by the same means of payment.

Our services are performed immediately: this is why, before you pay, we ask you to tick a box by which you expressly request immediate performance and acknowledge that you lose your right of withdrawal once the service has been fully performed (Article L221-28, 1° of the French Consumer Code). The service is fully performed: for a publication, as soon as the listing goes online; for a featured placement or a bump, as soon as it is applied; for an extension, as soon as the new end date is applied. If you withdraw after requesting immediate performance but before full performance, you owe us an amount proportional to the service already provided (Article L221-25). A listing refused before going online is refunded in full.

The professional subscription is reserved for professionals: the right of withdrawal under the French Consumer Code does not apply to it (see section 7).

Withdrawal form (to copy into your message): “To the attention of FPH, 2 rue Percheronne, 28000 Chartres, France, contact@minivanvintage.fr: I hereby give notice that I withdraw from my contract for the provision of the following service: [service and listing concerned]. Ordered on: [date]. Name: […]. Address: […]. Date: […].”

5. Complaints and mediation

For any complaint, please write to us first through the contact form or at contact@minivanvintage.fr; we reply within fifteen days. If you are a consumer and our reply does not satisfy you, or if you receive no reply within two months, you may, free of charge and within one year of your written complaint, refer the matter to the consumer mediator (médiateur de la consommation) we belong to: CM2C — Centre de la Médiation de la Consommation de Conciliateurs de Justice, 49 rue de Ponthieu, 75008 Paris — www.cm2c.net (referral online on that website or by post). The mediator may only be contacted after your complaint has first been sent to us in writing. You remain free to bring the matter before the competent court.

6. Governing law

These terms are governed by French law.

7. Professional subscription

The subscription is reserved for professional sellers (a business identified by an active SIRET number). Its price is shown both excluding and including VAT on the Prices page. For its duration, it entitles you to the services described on that page (included listings, included featured placements, showcase page, statistics).

Trial. The subscription begins with a free 90-day trial period, with no bank card required. Before the end of the trial, we write to you to offer to continue. If you do not register a means of payment, the subscription ends by itself, at no cost, and your online listings remain visible until their normal expiry.

Duration and renewal. The subscription is monthly or yearly. It renews automatically for the same duration, at the same price, unless cancelled. For the yearly subscription, we send you a reminder by e-mail at least thirty days before renewal.

Cancellation. You may cancel at any time from your account, in one click, or through the contact form. The subscription ends at the close of the period already paid, which is not refunded. Listings published during the subscription remain online until their expiry.

Payment. Payment is taken by bank card through Stripe at the start of each period. If a payment fails, we notify you by e-mail; if the situation is not resolved within fifteen days, the subscription is suspended and then cancelled. In accordance with Article L441-10 of the Code de commerce (French Commercial Code), any sum unpaid at its due date bears interest at a rate equal to three times the French statutory interest rate, and a fixed indemnity of €40 for recovery costs is payable. No discount is granted for early payment.

Changes to the terms. We notify you by e-mail at least fifteen days before any change to these terms or to the prices that concerns you. You may cancel before the change takes effect; after that period, the new terms apply from the next renewal.

Right of withdrawal. The contract is concluded between professionals: the right of withdrawal under the French Consumer Code does not apply. The free trial lets you test the service without commitment.
